For a job offer to be valid, it must meet certain criteria outlined below:

  • The job offer should provide guaranteed full-time, continuous, and paid employment for a minimum of one year after the PR is issued to the applicant. This means it cannot be a seasonal job offer
  • The job offered should be one of the jobs listed under the National Occupation Classification (NOC), which also meet the eligibility for Federal Skilled Worker or Canadian Experience Class programs.

Get Points Based on LMIA

When talking about LMIA to support a PR, things to keep in mind include:

  • The employer of the applicant must have received LMIA approval to support PR application.
  • The approval must include the applicant’s name and position.

When Must an Employer Get an LMIA to Support an Applicant’s PR?

  • If the applicant is working on an open work permit
  • When the job offer from the employer is not listed on the applicant’s work permit

Existing Work Permit Holder After LMIA Approval

If the applicant is already working with an employer in Canada, on a work permit that was issued based on an LMIA, here are a few things to keep in mind:

  • The applicant must be working for an employer listed on their work permit
  • The applicant must be authorized to work in Canada on the day the PR application is submitted
  • The applicant must be authorized to work in Canada on the day the visa is issued

Get Points Based on LMIA – Exempt Job Offer

If an applicant meets the requirements below, and already has a work permit that is LMIA- exempt, they may receive bonus points.

Minimum Requirements 

  • The applicant has completed one year of full-time or equivalent part-time work experience
  • Employment should be based on a valid employer-specified work permit within the jobs listed under the National Occupation Classification (NOC). The job should also meet the eligibility for Federal Skilled Worker or Canadian Experience Class programs
